TERMS AND CONDITIONS OF SALE

These Terms govern consumer purchases through www.nunsenseclothing.com. NUNSENSE is the brand name used on the website. Your seller is Raphael Griffiths.

1. Seller and contact details

Raphael Griffiths

75006 Paris, France
Email: hello@nunsenseclothing.com
Telephone: +33 6 13 88 63 41

Raphael Griffiths is responsible for orders, delivery, customer service and applicable statutory guarantees. Shopify provides the online store platform.

2. Scope and applicable terms

These Terms apply to customers purchasing for purposes outside their commercial or professional activity.

The version supplied when you order applies to that purchase. Changes apply only to future orders.

Nothing in these Terms limits mandatory consumer rights.

3. Products

Essential product characteristics, including materials, sizes, colours and price, appear on the product page. Please review the description and size information before ordering.

Images aim to represent products accurately. Differences in screen display do not remove your rights if goods fail to match their description.

Preorders and additional production periods are identified before purchase.

4. Prices and payment

Prices are displayed in euros and include applicable taxes. Delivery charges and any additional amounts payable to us are shown before you confirm your order.

Available payment methods appear at checkout. Payment is taken at checkout, subject to successful processing.

For shipments involving importation, we will explain before purchase whether duties, import taxes and carrier fees are included or payable separately. Where reasonably possible, we will state the amount or calculation method; otherwise, we will explain that additional charges may be payable. Applicable mandatory rules remain unaffected.

Price changes do not affect contracts already concluded.

5. Orders and acceptance

Before ordering, you can review and correct products, quantities, delivery details and the total price.

By selecting the final payment button, you acknowledge an obligation to pay and accept these Terms.

The sales contract is concluded when we send you our automated order confirmation email confirming acceptance of your order.

We will provide the confirmation and these Terms by email or another durable medium.

If we cannot fulfil an accepted order, we will notify you promptly and provide the refund or other remedy required by law. No substitute product will be supplied without your agreement.

6. Delivery destinations and periods

We deliver to all 27 European Union member states, the United Kingdom, Switzerland and the United States, subject to any address restrictions disclosed before purchase.

Preparation and transit times depend on the product, supplier, destination and delivery service. The applicable delivery date or period, including preparation time, will be stated on the product page or at checkout before purchase. Additional production periods will be disclosed before ordering.

Shipping charges and available services are shown before payment. Where tracking is available, we will send tracking information after dispatch.

We remain responsible to you for our contractual obligations, including where a supplier dispatches the goods.

7. Delivery problems

Check your delivery address before ordering and contact hello@nunsenseclothing.com promptly if it needs correcting or if a parcel is delayed, lost or damaged.

We will handle delivery problems with the carrier where appropriate.

Where the law requires, you may request delivery within an additional reasonable period and cancel if we still fail to deliver. Immediate cancellation is available where the statutory conditions permit, including refusal to deliver or failure to meet an essential delivery date.

Following valid cancellation for non-delivery, we will refund the sums due within 14 days.

Risk generally passes when you or your designated recipient, other than the carrier, physically receives the goods. Different statutory rules apply if you independently appoint a carrier we did not offer.

Failure to report damage immediately does not, by itself, remove statutory rights.

8. Order changes

Contact hello@nunsenseclothing.com as soon as possible to request changes or cancellation.

Our ability to amend an order depends on its processing stage. This does not limit statutory withdrawal rights or remedies for delivery problems or defective goods.

9. Right of withdrawal

We allow customers in all delivery destinations to withdraw without giving a reason within 14 days after they or their designated recipient, other than the carrier, receive the goods.

Where one order is delivered in separate parts, the period generally begins when the last item is received. More favourable mandatory local rights remain applicable.

Send a clear withdrawal statement to:

hello@nunsenseclothing.com

or:

Raphael Griffiths
1 rue de Vaugirard
75006 Paris
France

The form at the end is optional. Sending your notice before the deadline is sufficient; prior approval is not required.

[Insert the exact location or link of the required online withdrawal function once enabled. It must remain accessible throughout the withdrawal period and provide an acknowledgment on a durable medium recording the statement and submission date and time.]

10. Returns and return postage

After withdrawing, send the goods back within 14 days to:

Raphael Griffiths — NUNSENSE
1 rue de Vaugirard
75006 Paris
France

Return shipping is free, and we will provide a return label.

We cover necessary return costs for valid statutory claims involving defective, incorrect or non-conforming goods.

Any free-return promise made when an earlier order was placed remains applicable to that order.

You may inspect and try on clothing as in a shop. You are responsible only for reduced value caused by handling beyond what is necessary to establish the goods’ nature, characteristics and functioning.

Missing tags or original packaging do not automatically remove statutory withdrawal rights.

Package returns securely and retain proof of dispatch.

11. Refunds following withdrawal

For withdrawal from the entire order, we refund amounts paid, including the cost of our least expensive standard delivery option.

Additional costs for a more expensive delivery service are not refundable.

We refund within 14 days after receiving your withdrawal notice, but may withhold reimbursement until we receive the goods or evidence of dispatch, whichever occurs first.

We use the original payment method unless you expressly agree otherwise, without refund fees.

12. Additional 30-day return policy

In addition to statutory rights, you may request a return within 30 days after delivery, calculated from receipt of the last item where an order is delivered in parts.

Contact hello@nunsenseclothing.com within that period for instructions.

For the additional period outside statutory withdrawal rights, goods must be unworn or unused, with tags and original packaging, and accompanied by proof of purchase.

Return shipping is free, and we will provide a return label.

After receiving and checking an eligible voluntary return, we refund the product price to the original payment method.

This additional policy does not restrict statutory rights or mandatory local protections.

13. Personalised products and exchanges

Our own clothing designs, standard prints, sizes and colours are not automatically personalised goods. Their normal withdrawal rights apply, including where manufactured after ordering.

Where the legal exception applies, withdrawal does not cover goods made to an individual customer’s specifications or clearly personalised for that customer.

We will clearly disclose any such exception before purchase. Statutory guarantees still apply.

For exchange options, email hello@nunsenseclothing.com. We will explain stock availability, any price difference and applicable postage before agreement.

An exchange enquiry does not extend the withdrawal deadline unless we expressly agree.

14. Defective or incorrect goods

Contact hello@nunsenseclothing.com with your order reference and a description of the problem. Photographs may assist assessment.

We bear the costs required by law for valid statutory guarantee claims.

Voluntary return conditions, including tags and packaging requirements, do not restrict these claims.

15. Statutory guarantees

Raphael Griffiths is responsible for statutory guarantees. Claims may be sent to the email or postal address in Section 1.

New goods benefit from the French legal guarantee of conformity for qualifying defects appearing within two years of delivery.

Defects appearing during that period are generally presumed to have existed on delivery, subject to statutory exceptions.

You may request repair or replacement under the legal conditions, free of charge, within 30 days and without major inconvenience.

Where those conditions are met, a price reduction or termination and refund is available. Minor defects do not justify termination; the seller must establish that a defect is minor.

Statutory extensions, renewals and suspension of guarantee periods apply.

You also benefit from the hidden-defects guarantee under Articles 1641 to 1649 of the French Civil Code, allowing a price reduction or return for a refund where its conditions are met.

An action must generally be brought within two years of discovery, subject to applicable legal limits.

1° Le professionnel refuse de réparer ou de remplacer le bien ;

2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;

3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d'enlèvement du bien non conforme, ou s'il supporte les frais d'installation du bien réparé ou de remplacement ;

English translation

The consumer has two years from delivery of the goods to invoke the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer need only establish the existence of the lack of conformity, rather than the date on which it appeared.

Where the sales contract provides for the continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that digital content or digital service throughout the agreed supply period. During this period, the consumer need only establish the existence of the lack of conformity affecting the digital content or digital service, rather than the date on which it appeared.

Where applicable, the statutory guarantee of conformity requires the trader to provide all updates necessary to maintain the conformity of the goods.

The statutory guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience.

If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer requests repair but the seller requires replacement instead, the statutory guarantee of conformity is renewed for two years from the date the goods are replaced.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and receive a full refund upon returning the goods, if:

  1. The trader refuses to repair or replace the goods;

  2. Repair or replacement takes place after thirty days;

  3. Repair or replacement causes major inconvenience to the consumer, particularly where the consumer ultimately bears the cost of collecting or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;

  4. The lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is sufficiently serious to justify an immediate price reduction or termination. In that case, the consumer does not have to request repair or replacement first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for use because they are being repaired or replaced suspends the remaining guarantee period until the restored goods are delivered.

The rights described above arise under Articles L.217-1 to L.217-32 of the French Consumer Code.

A seller who obstructs the implementation of the statutory guarantee of conformity in bad faith may incur a civil fine of up to €300,000, which may be increased to 10% of average annual turnover under Article L.241-5 of the French Consumer Code.

The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or a full refund upon returning the goods.

16. Complaints and mediation

First send a written complaint to hello@nunsenseclothing.com or the postal address in Section 1.

If it remains unresolved, an eligible dispute may be referred free of charge to our appointed consumer mediator.

[Mediator name, postal address and website must be inserted after an agreement is in place.]

Mediation is optional for consumers and does not prevent access to a competent court.

17. Personal data

We process personal data to manage orders, payments, deliveries and customer enquiries.

Our Privacy Policy explains processing activities and your rights.

18. Applicable law and courts

These Terms are governed by French law.

This choice does not deprive consumers habitually resident elsewhere of mandatory protections applicable under relevant conflict-of-law rules.

Disputes may be brought before courts having jurisdiction under applicable law. Exclusive jurisdiction in Paris is not imposed.

19. Model withdrawal form

Complete and send this form only if you wish to withdraw.
